Stephen Allred <br />Assistant Secretary, Land and Minerals Management <br />JUL 2 <br />From: Brent Wahlquis?,?? / 3 2008 <br />Director <br />Subject: Recommendation for Approval of the Mining Plan Modification for Federal <br />Leases C-1362 and COC-56447 at Mountain Coal Company, L.L.C.'s West Elk <br />Mine located in Delta and Gunnison Counties, Colorado <br />I recommend approval of this mining plan modification under the Mineral Leasing Act of 1920, <br />as amended. My recommendation is based on: <br />1. Mountain Coal Company, L.L.C.'s complete permit application package; <br />• <br />2. Compliance with the National Environmental Policy Act of 1969; <br />3. Documentation assuring compliance with applicable requirements of other <br />Federal laws, regulations, and Executive Orders; <br />4. Comments and recommendations or concurrence of other Federal agencies and <br />the public; <br />5. The findings and recommendations of the Bureau of Land Management regarding <br />the resource recovery and protection plan, the Federal lease requirements, and the <br />Mineral Leasing Act; and <br />6. The Colorado Division of Reclamation, Mining and Safety's West Elk Mine <br />(Permit No. C-1980-007) Proposed Decision - Technical Revision No. 111 (TR- <br />111) E Seam Methane Drainage Wells for Longwall Panel E1 (Conceptual Plan). <br />• <br />The Secretary may approve a Mining Plan for a Federal lease under 30 U.S.C. §§ 207(c) and <br />1273(c).
