M-2008-009 Division of Reclamation, <br />REGULAR 112 CONSTRUCTION MATERIALS PERMIT APPLICATION Mining and Safety <br />The below listed Parties/Objectors, through the undersigned legal counsel, Reed F. Morris, Esq. <br />of the Law Offices of Ralph A. Cantafio, P.C., pursuant to the Minerals Rules and Regulations of <br />the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials, Rule <br />2.7.3(3), hereby formally withdraw as a Parties to the above captioned matters and state as <br />follows: <br />1. The Formal Public Hearing on this matter before the Mined Land Reclamation Board is <br />scheduled for August 13 and 14, 2008, at the Centennial Building, 1313 Sherman Street, <br />Room 318, Denver, Colorado, 80203, during the Board's August 2008 meeting. <br />2. The Lyster Pit 112 construction materials permit application ("Application"; M-2008- <br />009) was submitted by Lyster Oil Company, Inc. ("Applicant") to the Colorado Division <br />of Reclamation, Mining and Safety ("Division") on February 13, 2008. <br />3. Pre-Hearing Conference Officer Daniel I. Hernandez, conducted a Pre-Hearing <br />Conference in Craig, Colorado on July 29, 2008. <br />4. On April 3, 2008, the Division received a letter dated April 3, 2008 via facsimile <br />transmission from six individuals under a group name known as Concerned Citizens for <br />the Future of Moffat County.
