BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF MARATHON OIL COMPANY, MV NO. 2008-008, PERMIT NO. <br />M-2007-067 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on July <br />9, 2008 in Denver, Colorado for a hearing to consider a possible violation, corrective action <br />and civil penalties sought by the Division of Reclamation, Mining and Safety ("Division") <br />against Marathon Oil Company ("Operator") for mining without a permit, pursuant to the <br />requirements of § 34-32.5-109(1), C.R.S. <br />Travis Marshall appeared on behalf of the Division. Curtis Ryland was present on <br />behalf of the Operator, with Counsel Hugh Thatcher. <br />The Board, having considered the Division and the Operator's presentation and the <br />Unpermitted Construction Material Extraction or Exploration Operation Presentation Form <br />("Presentation Form") and the January 18, 2008 letter from Mr. Marshall to Doug Dennison <br />of Cordilleran Compliance Services Inc., submitted by Mr. Marshall and the slides presented <br />at the hearing by Mr. Marshall and a copy of the bond presented by Mr. Thatcher and having <br />been otherwise fully informed of the facts in this matter, hereby enters the following findings <br />of fact, conclusions of law and order. <br />FINDINGS OF FACT <br />1. The Operator applied for a 110c reclamation permit for the Circle Dot Quarry <br />site. The Division approved the Operator's,application on January 18, 2008 for the Circle <br />Dot Quarry site. The property is located in Section 1, Township 6 South, Range 97 West, of <br />the 6"' Principal Meridian in Garfield County, Colorado. The Circle Dot Quarry site consists <br />of approximately 9.11 acres. <br />2. On May 6, 2008, the Division conducted a routine inspection of the Circle Dot <br />Quarry site and determined mining related activities appeared to have disturbed the entire <br />9.11 acres within the approved permit area, including vegetation removal, topsoil and <br />overburden stripping, stockpiling of topsoil and overburden. <br />3. As of May 6, 2008, the Operator had not posted the financial warranty and the <br />Division had not issued the permit. <br />Marathon Oil Company <br />M-2007-067
