? <br />14 _zoOF, 03 7 <br />Bird, David I/ <br />From: Timothy Wheeler [timwheeler1 @msn.com] <br />Sent: Monday, August 11, 2008 9:42 AM <br />To: Bird, David 1/ <br />Subject: Official Objector to Venture Resources Inc's mining application <br />Dear Mr Bird, <br />Page 1 of 1 <br />As the owner of the O'Connor Lode MS# 6821 which overlaps the Emma Lode MS # 7261 and owner of the <br />Atlantic Lode MS # 10117 I, Tim Wheeler, wish to file my name as an official objector to the application for <br />mining operations. <br />My reasons for objecting to mining operations include, but are not necessarily limited to the following: <br />#1 There are four or more mining claims that overlap the Emma Lode and whose filings of certificate of location <br />are senior to the Emma Lode. These owner's right to mine supercede that of Venture Resources thereby <br />disallowing any mining operations by Venture. <br />#2 As an owner of two mining claims and prospective home sites in the immediate area of the proposed mining <br />operations I have grave concerns as to issues to do with pollution of the water table stemming from mining <br />along with a multipicity of other concerns. <br />#3 It is my belief that a 200 ft radius for notification is grossly insufficient and also that further effort needs to be <br />made to contact those owners that will be impacted by these operations for their response. <br />#4 There are numerous home sites and future home sites within a more extended radius that are guaranteed to <br />be negatively impacted in multiple ways by such large scale mining operations. These owners deserve to be <br />heard as well and if they are not notified and if their concerns are not addressed prior to approval, such an <br />omission can only serve to invite a series of lawsuits against all parties involved in the application process. <br />#5 Clear Creek County has both the right and the obligation to register it's range of concerns as a governmental <br />body and as a representative of the legal and economic rights of affected residents prior to any decision <br />regarding this application. <br />Please confirm receipt of this official letter prior to the deadline for comments. <br />Sincerely, <br />Tim Wheeler <br />8/13/2008
