Aug, 11 2008 2:43PM CLEAR CREEK LAND USE No. 1383 P. 3 <br />Protection and Reclamation Plans where such requirements are <br />appropriate." <br />The applicant's statement indicates in response to requirement (a) that no designated <br />chemicals will be on-site, However, supporting documentation to meet the <br />requirements of (b) appears to be incomplete. While chemicals will not be stoned at <br />the Emma, Addendum A indicates that chemicals will be utilized in the milling <br />process at an undisclosed location. We believe disclosure of the miling location and a <br />disclosure of the chemical characteristics of the resulting tailings, the slurry, the <br />ground water and the mine water at the Emma should be included in the documents. <br />We request a more specific discussion regarding the man-made underground features, <br />and the geology and hydrology of this area. We would appreciate careful review of <br />these requirements by the Division in order to determine whether an Environmental <br />protection Flan would be an appropriate requirement for this proposed operation. <br />Because Clear Creek County does not have a mining engineer on staff, we can only <br />highlight our concern that the plan to pump the mill tailings slurry back into the <br />Garland shaft may have an adverse effect on the surrounding environment. We <br />believe that the applicant should demonstrate that the plan submitted for this particular <br />site, the mill tailing slurry resulting from processing ore in order to recover gold, <br />silver, lead, zinc and copper, and that containment in the Garland shaft can meat the <br />requirements of this conversion rule. <br />Exhibit )F - List of Other Permits and Licenses Required <br />Our final concern relates to local permit requirements. While the applicant acknowledges <br />"that any structures greater than 200 sq. ft. will requite a building permit," this statement <br />is not an accurate reflection of the County's current Building permit requirements. Clear <br />Creek County is operating under the 2003 International Building Code (Section 105 <br />attached) which requires permits for structures larger than 120 square feet, Based on the <br />applicant's submittal, the 12'XI6' tool storage shed, the 12'X16' hoist building and the <br />10,000 gallon water tank all will require building permits from Clear Creek County. <br />We believe that the concerns raised regarding this application are appropriate matters for <br />a public hearing.
