The Division received a copy of the letter you sent to Teller County objecting to the amendment application.
CC&V had responded to your letter on July 18, 2008, which was copied to the Division of Reclamation
Mining and Safety. As you can see from the letter, CC&V has a, discharge permit from the Colorado
Department of Health and Environment, for the Carlton Tunnel Discharge and had been in compliance
with their approved permit conditions.
The Division would like to know, if you believe CC&V is in violation of their permit numeric protection
levels„ by loading Four Mile Creek from the Carlton Tunnel Discharge. Even though your letter was sent to
the County, and received by the Division after the comment period closed, for our review and permitting
process, the issues you raised, if accurate are with in the jurisdictional authority of the Division in the
protection of the probable impacts to the hydrologic balance.
