Cattany <br />Environmental Manager Division Director <br />29515 Routt County Road #27 Natural Resource Trustee <br />Oak Creek, CO 80467 <br />Re: Foidel Creek Mine, C1982-056, TR65 adequacy concerns <br />Dear Mr. Nettleton: <br />The Division has reviewed TCC's application for a technical revision, TR65, which proposes to extend <br />haul road B-2 and construct additional support structures to allow for improved efficiency at the Stoker <br />Truck Load Out. The load out is located north of the existing wash plant. The proposed extension of the <br />load out to the north will allow traffic pattern to flow better as the trucks are loading and minimize the <br />time trucks are required to maneuver under the stoker loading chute. <br />TR65 proposes to add a Coal Feed Conveyor, Coal transfer Conveyor, a twenty-foot conveyor extension, <br />three support Bents, concrete pad, and a support truss with walkway. Haul Road B-2 will have an <br />additional 0.1 acres expanded to the north. This expansion will be outside of the Pond E emergency <br />spillway path. The expansion will be in an area previously disturbed, regraded and reseeded by previous <br />activity at the mine. This area will also be within the 100 foot buffer zone for Foidel Creek. An <br />exemption for disturbance and activity within the buffer zone has previously been granted to Twentymile <br />Coal Company. Activity associated with this revision will be well south of the Foidel Creek channel and <br />banks. A well vegetated grass filter will be maintained and TCC proposes to also use silt fence or straw <br />wattles, to control sediment from the proposed disturbance. <br />The Division has identified two items that need response from TCC for this revision: <br />The Division was unable to locate a sedimentology demonstration for the area immediately <br />west of the Pond E emergency spillway and north of the stoker truck load out. Expansion <br />of the Stoker truck load out will require this area to be treated with alternate sediment <br />control (ASC) measures. Please direct the Division to where a SAE demonstration for this <br />area that does not drain to a sediment pond is located in the permit, or provide a <br />demonstration with a description of the ASC measures that will be implemented. <br />2.
