This <br />amount was estimated using a value of 20% as the percentage of water contained within <br />undisturbed soil. Free river conditions existed from December 18, 2007 through early 2008. <br />During this period the Applicant booked over water from the South Platte River into Sharkey's <br />Lake at a rate of 3.53 acre-feet per day, based on a maximum pumping rate of 800 GPM. This <br />took place with the approval for the Water Commissioner. Therefore, as of January 8, 2008, <br />77.66 acre-feet of fully consumable free river water has booked over to the reservoir. Such <br />water will be pumped to the South Platte River for replacement purposes during this plan <br />period. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />This SWSP shall be valid for the period of January 1, 2008 through October 31, 2008, <br />unless otherwise revoked, modified, or superceded by decree. This plan will be extended <br />until December 31, 2008, if the applicant submits a lease from the City of Longmont for <br />the period of November 1, 2008 through December 31, 2008 prior to October 31, 2008. <br />If this plan will not be made absolute by a water court action by the plan's expiration date, <br />a renewal request must be submitted to this office with the statutory fee (currently $257) <br />by August 31, 2008 (October 31, 2008 if extended). <br />2. The losses associated with this mining operation must not exceed a total of 43.55 acre- <br />feet for the duration of this permit approval. These losses include 38.55 acre-feet of <br />evaporation from the proposed maximum exposure of up to 13.0 acres of groundwater
