III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the New Horizon Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on 23-July-2008. Ross Gubka represented the operator, Western Fuels - <br /> Colorado, and was present throughout the entire inspection. <br /> Availability of Records <br /> Records were available at the mine office for review. A completed DRMS Availability of Records <br /> form is attached to this report. <br /> During the inspection, the operator provided the Division with a copy of the affidavit of <br /> publication for the SL-1 1 Public Notice that appeared in the San Miguel Forum. <br /> Roads <br /> Haul roads and light use roads throughout the permit area were maintained in good condition. <br /> Hydrologic Balance <br /> Pond 007 was full, with a continuous discharge; inflow consists solely of irrigation runoff. <br /> Pond 008 contained a substantial amount of water, but no discharge was occurring (valve was <br /> not open). <br /> Pond 009 was completely dry. <br /> Pond 011 was receiving inflow from the mine dewatering pump, at a rate of approximately 250 <br /> gpm. Discharge occurred at the same rate, with one of the two valves open. A few small rills <br /> were observed on the southern cut bank of the pond, due to irrigation runoff from the alfalfa <br /> field to the south. The operator had excavated a surface ditch to attempt to channel the water <br /> away from the slope and toward the run-down at the pond's southwest corner. <br /> Pond 012 held water only in the west end. Some rilling was evident in the eastern cut bank of, <br /> the pond (Figure 1) <br /> Pond 013 was dry,with the exception of a few puddles in the bottom. <br /> Pond 014 was dry. <br /> Topsoil <br /> A-Horizon topsoil has been stripped and pushed into a windrow in advance of the pit, extending <br /> west to the line of survey stakes that had been placed earlier in the year. The bulldozer operator <br /> had done a good job of separating isolating the soil based on depth and/or color. <br /> Fish & Wildlife <br /> A Great Blue Heron (Figure 2) was observed at Pond 007, along with a family of Canada Geese. <br /> The killdeer eggs observed at Pond 011 during the June inspection had hatched. <br /> Reveaetation <br /> The SL-I I Phase 2 Bond Release inspection will occur in late August. <br /> Air Resource Protection <br /> A water truck was actively providing dust control on the haul roads, filling its tank from the <br /> elevated storage tank at Pond 01 1. <br /> New Horizon Mine C-1981-008 23-Jul-2008 <br />
