III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Hamilton Mine conducted by Marcia Talvitie of the Colorado <br /> DRMS on Wednesday, 23 July 2008. No representative of the operator was present during the <br /> inspection. <br /> Mans and Markers <br /> Mine and permit identification signs were displayed at the County Road access, in accordance <br /> with Section 4.02.2. <br /> Roads <br /> The roads were dry and passable throughout the permit area. <br /> Hydrologic Balance <br /> Roadside ditch bottoms were damp, giving evidence of recent rainfall. <br /> Pond A was completely dry, and the spillway showed no signs of recent discharge. Cobble <br /> riprap has slid away from the black spillway liner in several spots, exposing the liner to sunlight <br /> (Figure 1). The liner shows little effect of deterioration, but riprap should be adjusted so as to <br /> cover the liner. <br /> Pond B continued to hold water(Figure 2), but the level had dropped since the June inspection, <br /> and there was no evidence of recent discharge. <br /> Topsoil <br /> Topsoil piles were protected by fence and clearly identified with signs. <br /> Fish &Wildlife <br /> A cottontail rabbit and hummingbird were sighted in the vicinity of Pond B, and tracks of deer, <br /> elk and coyote were observed in the mud surrounding the pond. <br /> Revegetation <br /> At Pond A, rubber rabbit brush and Indian Ricegrass were well established on the dam crest. <br /> Yucca was thriving below the spillway (Figure 3). <br /> Reclamation Success <br /> Tamarisk plants continue to thrive along the dam perimeter of Ponds A and B. Whitetop is <br /> somewhat plentiful around Pond A, <br /> Russian Knapweed was becoming established at numerous locations throughout the permit <br /> area. Several plants are clustered immediately southwest of Pond A, next to the fence, and <br /> other colonies were observed along the main access road and inside the western fence at <br /> Mining Area 1 (Figure 4). <br /> A copy of the Weed Control Plan from the Hamilton Mine Permit Application [pp 2.05-25 and <br /> 2.05-25(i)] is attached for reference. The operator is reminded to be diligent in holding to the <br /> tenets of its Weed Control Plan, particularly with respect to the weeds observed during the <br /> inspection. <br /> Hamilton Mine C-1991-078 23-Jul-2008 <br />
