Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Hall-Irwin Corporation; File No. M-1997-058 <br />Baseline Resources; Permit Amendment (AM-02) Adequacy Review <br />Dear Ms. Ortiz, <br />The Division has reviewed the content of Hall-Irwin Corporation 112c permit amendment (AM-02) <br />application for Baseline Resources, File No. M-1997-058, and submits the following comments. The <br />Division of Reclamation, Mining and Safety (Division) is required to make an approval or denial decision <br />no later than September 9, 2008, therefore, your response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2(1)(e), please submit proof of public notice circulated to all owners of <br />record of surface lands and easement holders that are on the affected land and within 200 feet of the <br />boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by <br />proof of personal service. <br />a. The Division did not receive proof of notice for the following adjacent landowners/structure <br />owners indicated on Exhibit C - Mining Plan Map. Please provide proof of notice to the <br />Division. <br />i. Paul A. and Ruth E. Struck <br />ii. Weld County <br />b. The Division did not received proof of notice for the following easement holders. Please <br />provide proof of notice to the Division. <br />i. Bataa Oil, Inc <br />ii. Qwest, Inc. <br />iii. United Power, Inc. <br />iv. Xcel Energy of Colorado <br />2. Rule 6.2.1(2) (b) requires that maps be prepared and signed by a registered land surveyor, <br />professional engineer, or other qualified person. The Mining Plan (Exhibit C) and Reclamation Plan <br />(Exhibit F) maps submitted to the Division were not signed. Please resubmit signed copies of the <br />maps. <br />3. The Division received comments from the Colorado Historical Society and Colorado Division of <br />Water Resources. The letters are attached for your review.
