Baseline Resources; Permit Amendment (AM-02) Adequacy Review
Dear Ms. Ortiz,
The Division has reviewed the content of Hall-Irwin Corporation 112c permit amendment (AM-02)
application for Baseline Resources, File No. M-1997-058, and submits the following comments. The
Division of Reclamation, Mining and Safety (Division) is required to make an approval or denial decision
no later than September 9, 2008, therefore, your response to the following adequacy review concerns
should be submitted to the Division as soon as possible.
1. As required by Rule 1.6.2(1)(e), please submit proof of public notice circulated to all owners of
record of surface lands and easement holders that are on the affected land and within 200 feet of the
boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by
proof of personal service.
a. The Division did not receive proof of notice for the following adjacent landowners/structure
owners indicated on Exhibit C - Mining Plan Map. Please provide proof of notice to the
Division.
i. Paul A. and Ruth E. Struck
ii. Weld County
b. The Division did not received proof of notice for the following easement holders. Please
provide proof of notice to the Division.
i. Bataa Oil, Inc
ii. Qwest, Inc.
iii. United Power, Inc.
iv. Xcel Energy of Colorado
2. Rule 6.2.1(2) (b) requires that maps be prepared and signed by a registered land surveyor,
professional engineer, or other qualified person. The Mining Plan (Exhibit C) and Reclamation Plan
(Exhibit F) maps submitted to the Division were not signed. Please resubmit signed copies of the
maps.
3. The Division received comments from the Colorado Historical Society and Colorado Division of
Water Resources. The letters are attached for your review. Please address the comments noted in the
letters and make changes in the application as necessary.
