Summary of DRMS Review

The Division's review of the MR-6 submittal consisted of verifying support of the
calculation of the Universal Soil Loss Equation that previously was submitted in TR-15.
The Division visually estimated vegetative cover on the mine site during an inspection on
June 17, 2008. The visual estimates and the data submitted in MR-6 support removal of
Stipulation 10 from permit C-1992-080. This review did not consider cover adequacy for
satisfying Phase III bond release requirements, but considered whether vegegative cover
was minimally adequate for pond removal, as previously explained in the review memo
for TR-15, dated 1/10/08, titled "Removal Checklist".
The 2006 Annual Reclamation Report for the Carbon Junction Mine indicates the last
seeding of the permanent seed mix on the site occurred in August 2006. Completion of
seeding was verified during the Division's inspection on August 17, 2006. Rule
4.05.02(2) requires that ponds be removed no sooner than two years after seeding;
therefore, the ponds at the Carbon Junction Mine shall not be removed until August
2008.
