We are reviewing the application <br />for compliance with Rule 3.02.3(2). This Rule requires the permittee to demonstrate that <br />development of the post-mining land use has substantially commenced and is likely to be <br />achieved. We have received residential plat maps of the site that you faxed on August 4, 2008. <br />Also, we have asked La Plata County and the City of Durango what further approvals will be <br />needed before additional residential development work can be done on the ground on the Carbon <br />Junction site (see attached copies of emails, dated July 31, 2008).
