III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection. The operator,Minrec.,has applied for Phase II and III bond release for the <br /> entire mine site. <br /> Roads <br /> The Hubbard Creek road was dry and in good condition. The mine road across Hubbard Creek also was in good <br /> condition. The front gate was closed and locked.The light use road that leads to pond 5 was dry and passable. <br /> The remaining part of the road past pond 5 has been reclaimed by Oxbow since they took over liability for it. <br /> Signs and Markers <br /> The mine ID sign and the records location sign were on the mine site front gate. Surface disturbance markers <br /> were up around the mine site. <br /> Hydrology <br /> Pond 4 was completely dry. The pond embankment was stable and well vegetated while the pond spillways <br /> were operational. The road culvert that leads to pond 4 was clear. The upland diversion ditch at the reclaimed <br /> coal stockpile area had sufficient capacity.Pond 5 was also completely dry. The primary discharge pipe valve <br /> was in the closed position and the emergency spillway had sufficient capacity. The collection ditch leading into <br /> pond 5 was well vegetated and had enough capacity. The black plastic culvert that brings the reclaimed mine <br /> bench water down to the pond 5 collection ditch was in place. <br /> Reclamation <br /> The reclaimed main mine site appeared to be stable. There were no indications of slope instability.No erosional <br /> gullys were observed and the highwall was covered. The reclamation at the former coal stockpile area was also <br /> stable. <br /> Noxious Weeds <br /> There are a lot of small thistle plants growing on the upper section of the main reclaimed mine site.Additional <br /> thistle plants are scattered around the north half of the site.These thistle plants need to be sprayed very soon. <br /> Records <br /> The mine records were located in the Delta County Clerk and Recorder office in Delta. The required records <br /> were in compliance. <br /> c:/word/blueribbon/insp07O8 <br />
