M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was an aerial inspection of the McClane Canyon Mine conducted by Harry Ranney of the <br /> Division of Reclamation, Mining and Safety(DRMS). Aerial photographs were taken on July <br /> 10, 2008 at approximately 11:31 a.m. Only one photograph was available for review. Weather <br /> conditions appeared to be clear and sunny at the time of the flight. Mike Boulay of the DRMS <br /> reviewed the aerial photograph. <br /> The portal area of the mine site was visible in the photograph. The coal waste storage area and <br /> the office location were not. The only activity discernible in the photograph is at the coal <br /> stockpile where a loader was loading coal onto a haul truck. The portion of the mine site haul <br /> road visible in the photograph was dry, and appeared well maintained and in good condition. <br /> Ground conditions at the mine site were dry. The sediment pond was not visible in the <br /> photograph. <br /> The portal facilities area is well maintained. All site locations visible in the photograph appeared <br /> stable and no significant erosion or other problems were identified with this aerial inspection. <br />
