III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was an aerial inspection of the Roadside Portals Mine conducted by Harry Ranney of the <br /> Division of Reclamation, Mining and Safety(DRMS). Aerial photographs were taken on July <br /> 10, 2008 at approximately 11:41 a.m. Weather conditions appeared to be clear and sunny at the <br /> time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br /> Six photographs were taken during the flyover. The portions of the mine site visible in the <br /> photographs include the North Decline, South Portals area, and the CRDA waste disposal sites <br /> (CRDA-1 and CRDA-2). Xcel Energy trucks were hauling ash from the Cameo Steam Plant to <br /> the ash disposal site adjacent to the permit area. There was no other activity discernible in the <br /> photographs. <br /> The mine site roads visible in the photographs adjacent to Coal Creek were dry, and appeared <br /> well maintained and in good condition. The road up to the shop and warehouse at the South <br /> Portal was in good condition. The facilities area and perimeter locations at the South Portal were <br /> well maintained and no problems were noted during this inspection. <br /> The mine site was dry. The only sediment Ponds apparent in the photos were Ponds 6 and 11 <br /> near CRDA-1 and Ponds 8 and 9 at the South Portal area. All of these sedimentation ponds were <br /> dry and appeared to be functional. <br /> All site locations appeared stable and no significant erosion or other problems were identified <br /> with this aerial inspection. <br />
