III. Comments - Compliance <br /> Below are particular issues with regard to any of the above compliance items. Enforcement <br /> actions resulting from failure to comply with the Act, Rules and Regulations, and the permit <br /> also are identified below. <br /> 1. The. sediment control system was being well maintained and was in compliance. The <br /> lower pond below the refuse pile was being cleaned at the time of the inspection. <br /> 2. Mid-Continent has had excellent success in revegetating the steep slopes of the <br /> coal processing waste pile. The dominant species are bromes and wheatgrasses, though <br /> numerous pine seedlings and, rose seedlings have also been established. <br /> 3. Final reclamation at Coal Basin will entail revegetating slopes approaching 100% <br /> at elevations above 10,000 feet. The operator proposes to establish test plots on <br /> the steep slopes of the 4 mine bench to evaluate various stabilization techniques <br /> and reclamation species. . The investigations will include an inventory of species <br /> which have naturally colonized the steep bench outslopes and collection of seed <br /> for use in reclamation trials if an adequate seed source is available. Relatively <br /> few species are adapted to the short growing season, steep slopes, cold temperatures <br /> and low nutrient status. which characterize the site. Most of these species are not <br /> readily available from, commercial sources. The operator has been commended in the <br /> past for revegetation of pre-law portions of the spoil pile, and the continued efforts <br /> to insure successful reclamation under harsh environmental conditions is appreciated. <br />
