2. The application states on page 2.10-2 that "The Cultural Resources Inventory <br />Report [is] presented in Volume VI. The BLM withholds the locations of the sites from <br />the applicant." Please be advised that Rule 2.10(1)(g) requires that this map be <br />submitted. Also, Rule 2.07.5(b) reads "Information in permit applications which pertains to <br />the quantity of the coal or stripping ratios, or the analysis of the chemical and physical <br />properties of coal to be mined (excepting information which the Division reasonably believes <br />to concern a mineral or elemental content which is potentially toxic in the environment) and <br />information on the nature and location of archeological resources on public and Indian land <br />(as required under the Archeological Resources Protection Act of 1971, PUB. L. 96-95, 93 <br />State. 721, 16 U. S. C. 470) shall (emphasis added) be kept confidential and not made a <br />matter of public record" <br />Please submit the required map showing eligible cultural sites and sites to be avoided, <br />clearly labeling this map as CONFIDENTIAL. <br />Rule 2.05.6(6) Subsidence Survev Monitorinq, and Control Plan <br />3. Please identify and describe in the permit text the gas pipeline and powerline <br />crossing the permit boundary in the far SW corner of Section 9 and the NW corner of <br />Section 16. Also, indentify on page 2.05-119 Map 24, in addition to Map 9 and Map 23, <br />as one of the maps showing structures in and adjacent to the permit area. <br />4. Rule 2.05.6(6)(e)(i)(E) requires a description of the angle of draw predicted to be <br />characteristic of the permit and adjacent area. Although Exhibit 15 discusses angle of <br />draw in general terms, no specific angle appears to be predicted for Red Cliff mining. <br />Please submit specific angle of draw predictions for Red Cliff mining. <br />5. Considering the rough terrain and topography in the affected area, the Division <br />is interested in the possibility of establishing survey monuments to verify the <br />predicted angle of draw as a result of Red Cliff mining, as well as for potential future <br />permitting and mining in areas of more significant structures and renewable <br />resources. Please provide your comments regarding the potential for field verification <br />of the actual angle of draw in the first few panels proposed for mining at Red Cliff. <br />6. The Division believes that in areas of shallow overburden (<250 feet) and steep <br />slopes, the potential exists for surface cracks to develop that may be a hazard to <br />recreational use and grazing. Please consider a plan for periodic monitoring and <br />mitigation (if warranted), for these areas, as shown on Map 14. <br />7. Please add the outline of the planned affected area, as shown on Map 14, to all <br />of the maps that depict structures or renewable resources (Maps 9, 23, and 24 at this <br />time). <br />8. In accordance with Rule 2.05.6(6)(f)(vii), please submit a schedule for the <br />submittal of a detailed plan of the underground workings, as required by Rule 4.20.1(3) <br />and indicate your preference regarding the confidentiality of this information.
