Al <br />b. Whenever possible cross drains should be located to release water on convex <br />slopes or other stable areas that will disperse water rather than channeling it. <br />c. Cross drains should be constructed with an outslope grade of 3% to 5% or <br />equal to the existing out-slope grade. <br />o Do not harass, harm or kill any reptile species unless human health or safety is at risk. <br />o No surface disturbing activities shall occur within % mile of active raptor nests between <br />May 15`h and July 15`h. No surface disturbing activities at any time within %4 mile of active <br />raptor nests. Primary species of concern include peregrine falcon and ferruginous hawk, but <br />all raptors should be considered. <br />o Migratory birds: Breeding bird surveys shall be conducted-for activities which are planned to <br />occur between May 15`h and July 15`h. All migratory bird nests for species indicated above <br />shall be avoided by project activities. Every effort will be made to insure that no direct <br />mortality of any migratory bird species occurs in the project area, and that no nests, eggs or <br />individual birds are harmed during the operation's activities. <br />o To insure the protection of elk and deer winter range habitat, no surface disturbing activities <br />are permitted to occur between December 1 s` and April 301h. <br />o To reduce impacts to sensitive plant species, a plant survey for the species listed below is <br />advised where operational activities would involve the use of heavy equipment causing new <br />surface disturbance off the existing access ways or drill sites. These surveyed areas should <br />include a 50 foot buffer zone surrounding the location. If present, operation activities will <br />avoid the following species (common name / species name) : <br />• Grand Junction Milkvetch / Astragalus linifolius <br />• Naturita Milkvetch / Astragalus naturitensis <br />• San Rafael Milkvetch / Astragalus rafaelensis <br />• Sandstone Milkvetch / Astragalus sesquiflorus <br />• Kachina Daisy / Erigeron kachinensis <br />• Dolores Skeleton Plant / Lygodesmia doloresensis <br />• Eastwood Monkey Flower (riparian areas only) / Mimulus eastwoodiae <br />• Paradox Breadroot / Pediolmelum aromaticum <br />o Be advised that wild land fires can occur at any time, but especially during our summer fire <br />season. As the operator of a minerals related project, it is your responsibility to take every <br />reasonable precaution against initiating accidental fires. As the operator you may be held <br />liable for the costs associated with fighting a fire your operations have caused. Also, it is the <br />policy of the BLM to allow some natural caused fires to burn as part of our "Fire Use" <br />policy. If a fire use wildfire presents a safety issue with your operation, you may be asked or <br />even ordered to evacuate the area. Please comply with all fire management direction when <br />instructed to do so.
