CC&V has quickly addressed past permit exceedances to prepare for future <br />"upset" conditions. "In 1996, CC&V enlarged the existing four settling ponds and added <br />a fifth pond to address the TSS exceedances. In August 1998, it removed sediment from <br />the trough to address the TSS and zinc exceedances and WET violations" (i). And in <br />2000, after cyanide exceedances, "It installed two experimental ponds in September 2002 <br />for the purpose of reducing toxicity, to adjust pH levels, to address the cyanide violations <br />and to remove aluminum and other metals from the water (ibid). What this shows is that <br />CC&V is quick to remediate problems, but mostly after-the-fact, and it also shows that <br />problems can and have occurred. Park Center objects to another four years or twenty <br />years of status quo, where District users bear the costs of poor water quality while CC&V <br />enjoys the benefits of record gold prices. <br />CC&V has gone to extensive efforts and expense to reclaim mining areas for the <br />aesthetics of the Cripple Creek area and the Colorado tourist. Park Center Water District <br />would suggest that they put an equal amount of effort into addressing problems that can't <br />be readily seen but concern the health and safety of over four thousand residents of the <br />Park Center Water District. We would like to avoid an emergency, a crisis to our user <br />caused by the mining activity. Two specific remedies that could be considered are 1) <br />jointly seeking additional water supplies to dilute the waters of Fourmile Creek and <br />effectively lower the sulfates and metal levels, and 2) design and installation of a <br />pretreatment Reverse Osmosis system adjacent to the Park Center Water Treatment Plant. <br />We are open for any other suggestions or possibilities. <br />Therefore, Park Center Water District hereby objects to the Mine Extension for <br />Cripple Creek & Victor Gold Mine. <br />rG ?ScM.z d <br />Deborah Marsicano <br />District Manager <br />Park Center Water District <br />(1)In the United States District Court for the District of Colorado, Document 309, Civil <br />Action No. 00-cv-02325-MSK-MEH, Sierra Club and Mineral Policy Center, plaintiffs, <br />v.
