Cattany <br /> <br />711 Independent Ave. <br />Director <br />Division <br />T <br /> rustee <br />Natural Resource <br />Grand Junction, CO 81505 <br />Re: CAM Mining LLC, McClane Canyon Mine (Permit No. C-1980-004) <br />Technical Revision No. 16 (TR-16) Adequacy Response Review <br />New Coal Mine Waste Pile and Associated Facilities <br />Dear Mr. Velarde: <br />The Colorado Division of Wildlife (DOW) was notified of the McClane Canyon Mine's TR-16 <br />application and responded by sending written comments to the Division of Reclamation, Mining and <br />Safety (DRMS) dated January 25, 2008. The DRMS forwarded your comment letter to the operator <br />and requested that CAM Mining LLC respond to your concerns and amend the application <br />accordingly. DOW's concerns focused on water quality impacts to East Salt Creek, and possible <br />hazards to wildlife associated with the proposed sediment pond. <br />The operator's response referenced revised Appendix N, which they state demonstrates that the water <br />quality of East Salt Creek will not be adversely impacted. Their response also addresses DOW <br />concerns with the sediment pond, and indicates that lining of the sediment pond is not warranted. <br />Further, the operator agrees to realign the BLM Drift Fence and the current design provides for a 5:1 <br />ramp on the east side of the sediment pond that could be used by wildlife as an escape. <br />We are requesting your review of the operator's response. The operator submitted a new Appendix N, <br />which describes probable hydrologic consequences to East Salt Creek.
