The map has been prepared <br />according to Rule 6.2 in the required scale that is appropriate to show all elements of the <br />areas addressed. <br />Adequacy Comment No. 2 - On June 16, 2008 American Soda sent a letter to Paul <br />Daggett at the BLM office in Meeker requesting written clarification of the status of the <br />main access road from County Road 5 to the main plant facility. A copy of this letter was <br />also sent to your office. Paul responded by electronic mail to both DRMS and American <br />Soda on June 30, 2008. He attached two BLM right-of-way documents and indicated that <br />these facilities and access are expected to remain in-place for more than 30 years. The <br />lease documents indicate that the right-of-way holder is responsible for the reclamation of <br />the site and facility (Enclosure #2). The access road is not included in the Amendment. <br />Adequacy Comment No. 3 - On June 17, 2008 American Soda sent correspondence to <br />DRMS including sections of the original Purchase and Sale Agreement between American <br />Soda and EnCana. This agreement as well as the terms and conditions of the sodium <br />minerals leases should still provide American Soda with the necessary access to the well <br />field. This letter is not reproduced as a separate enclosure in this document.
