The
West Elk Mine Permit (C-1980-007) is held by Mountain Coal Company LLC. Under Minor Revision MR-347,
Mountain Coal Company proposes to construct the Panel E-1 drill pads, roads, and methane de-gas wells
approved in concept under Technical Revision TR-111.
As you may recall, the Division's proposed decision of June 9, 2008 to approve Technical Revision TR-111
became the subject of a Formal Public Hearing conducted by the Colorado Mined Land Reclamation Board on
July 9, 2008. The board affirmed the Division's proposed decision at the hearing, thereby rendering our proposed
decision to approve TR-111 final on July 9, 2008. The activities proposed in Minor Revision MR-347 are as
described in Technical Revision TR-111.
Attached are the cover letter and DRMS application form submitted by Mountain Coal Company that
accompanied the Minor Revision MR-347 application package. I would appreciate hearing from you as to
whether you believe Minor Revision MR-347 would require modification of Mountain Coal Company's federal
mine plan.
Thanks,
lnanieCL Mernandez
Daniel 1.
