Otherwise, please update the permit page in Tab 3, Attachment 3-5. <br />26. We have questions regarding documentation of landowner request for retention of proposed <br />permanent facilities. Specifically, there are very specific requests provided in Attachment 20-1 <br />for retention of permanent structures on portions of the disturbed/reclaimed area owned by <br />Seneca Coal Company, John Patrick, and Dennis Hallenback. There is also a February 1995 <br />consent statement from Charles B. Carroll, which would appear to provide the required road <br />retention request for the Carroll family property. No retention requests were provided from 20 <br />Mile Sheep Company, or Wilton Earle & Sons, who would appear to own parcels affected by <br />retention of the access road connecting RCR 27 with the mined area. <br />In addition, there is reference to Yampa Valley Electric Association's (YVEA) desire to retain <br />the powerline extending from the Rockcastle road up through the permit area to the substation, <br />but written documentation from YVEA was not provided. Also, the disturbance corridor <br />associated with the powerline appears to pass through property owned by Public Service <br />Company of Colorado (PSCO), but there was no letter of request from PSCO for retention of <br />the powerline. <br />Please clarify whether Charles B. Carroll is the spokesman for the Carroll Family <br />property, address the apparent discrepancies regarding retention requests from 20 Mile <br />Sheep Company, Wilton Earle & Sons, YVEA, and PSCO, and amend the application <br />accordingly. <br />27. The Surface Disturbance Boundary is well marked within the mine area portion of the permit <br />area on map Exhibit20-2, but is not delineated within the entrance road portion of the permit <br />area, which connects the mine area with RCR-27. Of particular note is the area labeled <br />"Dragline Deadhead" along a stream segment in the northern portion of the road corridor <br />segment. Also, topographic lines are not provided for the portion of the permit area near the <br />intersection with RCR-27, which is owned by Hallenbeck. <br />Please amend Exhibit 20-2 to include disturbance boundary delineation along the road <br />corridor, including "Dragline Deadhead". Also, please describe the nature and extent of <br />disturbance and reclamation on the Hallenbeck property, and include topographic <br />contours for the portion of the Hallenbeck property that was disturbed. <br />2
