A follow-up call was <br />made to Paul yesterday at which time he indicated that he would respond to our request. <br />He agreed to provide the letter requested. Our letter asked for his response by June 30, <br />2008 so we can forward it to you and you will have time to review it prior to our requested <br />extension date of July 21, 2008. <br />In addition to the clarification concerning the road as a permanent feature, we also <br />researched the original Purchase and Sale Agreement between American Soda and <br />EnCana. Enclosed are the first five pages of the multi page sale agreement. Sections and <br />individual words on page 4 and 5 relating to our retained right to use the access road are <br />highlighted. <br />On page 5 the definition of "Seller's Plant" is provided: <br />"Seller's Plant" means the facilities owned by Seller in Rio Blanco County Colorado and used for the <br />extraction or processing of sodium-containing minerals. <br />On page 4 subheading "Properties": <br />"Properties" means, and only means, all of Seller's title, if any, in the following properties (real, personal or <br />mixed) and rights (contractual or otherwise) unless expressly reserved or excluded herein: <br />On page 4 item b. under "Properties" <br />b.
