June 30„ 2008 <br />Re: Hayden Gulch Loadout - RN-03 <br />Responses to Adequacy Comments <br />Page 2 <br />Hayden Gulch Loadout is $1,079,517.00. This is a -0.4% difference (-$4, 395.00) from the <br />current liability of $1,083,912. 00. The Division currently holds two bonds totaling <br />$1,084,161.00. The current bond is sufficient and no additional monies need to be submitted <br />for this permit renewal. A copy of the Division's reclamation cost estimate is included with <br />this letter. <br />Response: In response to CDRMS' updated reclamation liability estimate HGTI has revised Tab 23, <br />Bonding. HGTI's revised material includes the reclamation liability incurred as part of MR-16 <br />calculated a reclamation cost liability of $1,082,271.00 (see Tab 23, page 10); the CDRMS' <br />reclamation cost estimate for RN-03 includes the MR-15 liability (see Task 037). HGTI's estimated <br />liability ($1,082,271.00) is less than the bond amount held by CDRMS ($1,084,161.00). Please insert <br />the revised material in accordance with the accompanying insertion instructions. <br />Rule 4.05.13 requires establishment of ground water `points of compliance" if, in the judgment of the <br />Division, the operation has the potential to negatively impact the quality of ground water for which <br />quality standards have been established by the Water Quality Control Commission. The Division has <br />reviewed the need for establishing ground water points of compliance at the Hayden Gulch Loadout <br />and has concluded that points of compliance currently are unwarranted at the loadout based on the <br />poor quality of ground water in Dry Creek alluvium and the low permeability of the Lewis Shale. <br />Response: No response required. However, to help future reviewers HGTI believes it will be <br />beneficial to included CDRMS' groundwater point of compliance finding into the permit application <br />package.
