discussion with DOW confirms that aspen and/or tall shrub planting areas are <br />warranted (see Item 13), elk fencing will be a required component of the <br />reclamation plan. <br />Please include commitment and detailed plans for provision of at least one <br />elk fenced shallow or rocky soil mountain shrub planting area, and two or <br />more fenced "thick topsoil" aspen/tall shrub planting areas, within <br />appropriate locations in the post-2008 wildlife habitat emphasis areas. <br />15. The Division pointed out that issues concerning pre and postmining land use, <br />AVF status, and restoration of essential hydrologic functions for lands disturbed <br />by the Gossard Loadout facilities was not well defined in the current permit <br />application. The Division requested Colowyo to identify premining and proposed <br />postmining land uses, and provide a detailed revegetation plan including proposed <br />revegetation success standards as appropriate, for the loadout area. For those <br />portions of the Gossard Loadout facilities within the AVF boundary, the Division <br />requested narrative demonstrating how the proposed reclamation/revegetation <br />plan will restore the Essential Hydrologic Functions of the alluvial valley floor. <br />The operator requested in their response that modifications to the future <br />reclamation of the loadout be put on hold until such a time as the Division and <br />Colowyo can discuss the issues in depth and agree upon a path to resolve the <br />technical aspects associated with the issue. Because the loadout issue did not <br />arise from the TR-72 proposal, the Division agrees that it would be appropriate to <br />address the concern within a separate permitting mechanism, perhaps the next <br />permit renewal application. <br />Please provide a narrative commitment within the appropriate section of the <br />permit application, to clarify pre and postmining land uses, AVF status, <br />reclamation plan, and AVF restoration of essential hydrologic functions for <br />the Gossard Loadout, in the next permit renewal application following <br />approval of TR-72. <br />Planting and Seeding Methods in amended Section 2.05.4 <br />16. The Division requested the operator to amend the pertinent narrative sections on <br />pages 2.05-58 and 2.05-59 to incorporate the strip seeding technique as standard <br />procedure on slopes steeper than 10%. The operator provided amended language <br />that adequately addressed this concern. Item Resolved. <br />Mulching Techniques in amended Section 2.05.4 <br />17.
