Sherman <br />Executive Director <br />Dick Wolfe, P.E. <br />Director <br />This letter is to inquire as to the status of the above reference gravel pit site. According to a <br />field inspection performed on Bucklen Pit M1982-131 by Ms. Erica Crosby from the Division of <br />Reclamation Mining and Safety ("DRMS") on April 3, 2008, there are approximately 19 acres of <br />exposed ground water at the Bucklen Pit. It is our understanding that a reduction in the permitted <br />t/acreage has been requested to reduce the mining site by approximately 19 acres. <br />According to Section § 37-90-137 (11), C.R.S., for any gravel pit that exposed ground water <br />to the atmosphere after December 31, 1981, the out-of-priority depletions must be replaced in time, <br />location, and amount to prevent injury to other water rights. Since reclamation of this site will result <br />in the continued existence of a ground water pond, an augmentation plan or substitute water supply <br />plan must exist for this site, unless you can demonstrate the entire ground water surface was <br />exposed prior to 1981. By this letter, we are requesting confirmation if an augmentation plan exists <br />for this site, or if you can demonstrate that the entire ground water pond was exposed prior to 1981. <br />Please provide the requested information by June 30, 2008. <br />In the event a substitute water supply plan is needed, I have enclosed a copy of our <br />Guidelines for Substitute Water Supply Plans for Sand and Gravel Pits for your reference.
