Attachment A <br />Measures to Protect Federal Resources on NFS Lands <br />Bowie Resources, TR-52, Methane Drainage Wells <br />Wildlife <br />1. Each year of project implementation the operator will perform breeding birds surveys in <br />accordance with USFS direction and policy. Habitat type and species of concern will be <br />determined by the Responsible Official in cooperation with the District Wildlife Biologist. <br />2. Surveys for raptors shall be conducted prior to surface disturbing activities to determine locations <br />of individuals or populations of these species. This applies specifically to goshawks, peregrine <br />falcons, and golden eagles but may apply to other species if located during surveys. <br />3. No activities shall be allowed within'/4 mile of an active northern goshawk nest from March 1, to <br />July 31 if they would cause nesting failure or abandonment (LRMP III-26) <br />4. No activities shall be allowed within '/4 mile of an active flammulated owl nest from March 1 to <br />July 31. <br />5. No activities shall be allowed within one mile of an active bald eagle or peregrine falcon nest from <br />February 1 to July 31 if they would cause nesting failure or abandonment. (LRMP III-33) <br />6. No surface occupancy beyond historic levels within % mile radius of active golden eagle nests. <br />(CDOW 2008). Seasonal restriction to human encroachment within %2 mile radius of active nests <br />from December 15 through July 15. (CDOW 2008) <br />7. <br />Vegetation/Soils <br />8. Any hay or straw used shall be certified as weed free.. <br />9. The Operator will be responsible for controlling noxious weed infestations on all NFS project <br />disturbance areas from the date of discovery up to the point of release of the CDRMS reclamation <br />bond and associated reclamation liability. Any herbicides used must be USFS approved and will <br />be applied at the recommended rates by a certified applicator in compliance with State laws. <br />10. All heavy equipment and drilling equipment will be washed, and free of mud, debris, etc, prior to <br />entering NFS lands. <br />11. Sediment control measures such as, but not limited to, vegetative slash, silt fence, straw mulch, <br />site containment and sediment control ponds will be utilized as needed. <br />12.
