The Division completed an update of the reclamation cost estimate for the
Eagle Mine Complex in conjunction with the review process (attached). The
revised liability for the site was calculated at $3,339,467.00. The Division
currently holds a corporate surety in the amount of $3,552,679.00 from
Travelers Casualty and Surety Co of America. The Division has determined
that the amount of bond held is sufficient to ensure that reclamation can be
completed in the event of permit revocation and bond forfeiture. The
additional bond monies can be returned to the BTU Empire Corporation
following the bond reduction process. This process can be initiated with
either a Technical Revision or a Bond Release application.
Miscellaneous
9. The page numbers in the Table of Contents for text portions of the permit does
not fit with the page numbering in the text. For example, the Table of
Contents states that Rule 2.04.11 Fish and Wildlife Information is on page
2.04.11-1. The text of the permit, however, has this information on page 2.04-
38. Please update the Table of Contents for the permit so it matches the
text portions of the permit.
This completes the preliminary adequacy review of the Eagle Mine Complex for Permit
Renewal 05.
