Some clarification to Niccole's email below. The dates listed only apply to when the
Forest Service can take action on our decision. For this situation, acting on our
decision constitutes sending consent/concurrence to OSM and DRMS for proceeding with
processing of the mine plan modification and permit action(s). The consent/concurrence
includes conditions for use of national forest system lands, identifies the post-mining
land use per FLMA role/responsibility in the federal coal program.

DRMS will be receiving a copy of a concurrence letter submitted to OSM in the next few
days. The Forest Service NEPA and appeal process has been completed. An appeal had been
filed on April 28, 2008. This NEPA decision was was affirmed in the appeal process and an
appeal disposition was issued on June 2, 2008. Implementation under 36 CFR 215 § 215.9(b)
may occur on June 23, 2008, therefore right of entry should also be that date.
