3. Permit Tab 20, Appendix 20-1 page 2, states that landowner comments regarding Post- <br />mining land use are found in Appendix 20-1 A. Appendix 20-1 A is empty. Please <br />provide these comments from the affected landowners. <br />4. The Division has conducted a Reclamation Cost Estimate that reflects costs the Division <br />would incur, in the event that the Division should need to conduct reclamation activities <br />at the Hayden Gulch Loadout. The estimate has been calculated for the disturbances <br />currently approved in the permit (includes TR6 structures and proposed disturbances), and <br />uses equipment and labor costs updated in 2007. The Division reclamation cost liability <br />for the Hayden Gulch Loadout is $1,079,517.00. This is a -0.4% difference (-$4,395.00) <br />from the current liability of $1,083,912.00. The Division currently holds two bonds <br />totaling $1,084,161.00. The current bond is sufficient and no additional monies need to <br />be submitted for this permit renewal. A copy of the Division's reclamation cost estimate <br />is included with this letter. <br />Rule 4.05.13 requires establishment of ground water "points of compliance" if, in the judgment of the <br />Division, the operation has the potential to negatively impact the quality of ground water for which quality <br />standards have been established by the Water Quality Control Commission. The Division has reviewed <br />the need for establishing ground water points of compliance at the Hayden Gulch Loadout and has <br />y <br />concluded that points of compliance currently are unwarranted at the loadout based on the poor qualit of <br />ground water in Dry Creek alluvium and the low permeability of the Lewis Shale. <br />The proposed decision date is June 20, 2008.
