Cattany <br />_--Division Director <br />Re: Climax Mine, Technical Revision Approval, Permit No. M-1977-493, Revision No. TR-14 Natural Resource Trustee <br />Dear Mr. Kloska: <br />On June 2, 2008 the Division of Reclamation, Mining and Safety approved the Technical Revision application submitted <br />to the Division on May 13, 2008, addressing the following: <br />Tenmile tunnel rehabilitation; tailing delivery line; Robinson Lake pump station/pipeline; and new mill building. <br />The terms of the Technical Revision No. 14 approved by the Division are hereby incorporated into Permit No. M-1977- <br />493. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-1977-493 <br />remain in full force and effect. <br />Stipulation No. Description <br />Prior to January 1, 2009, provide a cost estimate for decommissioning and demolition of new mill and <br />accessory buildings and for the new tailing delivery line. <br />2 Prior to taking delivery of designated chemicals at the new mill and accessory buildings, submit and gain <br />approval of an Emergency Response Plan as required under Rule 8.3 of the Hard Rock/Metal Mining <br />Rules and Regulations. <br />If you have any questions, please contact me at 303-8664063. <br />Sinc y <br />Allen C.
