Response 3: Climax is currently updating the reclamation bond costs to reflect the TR-14 <br />modifications in support of the 2010 restart construction schedule. Climax requests DRMS to defer <br />provisions of the estimate to later in 2008 as a stipulation in the TR-14 approval letter. <br />Comment 4: In accordance with Hard/Rock Metal Mining Rule 7.4, DRMS intends to incorporate an <br />inspection schedule into TR-14 approval for the extensive Environmental Protection Facility <br />construction work that will take place at Climax during 2008. In order to schedule inspections of the <br />proposed Robinson Lake pipeline, please describe the pipeline burial schedule. In particular, will <br />the pipeline be tested and buried in phased sections as construction progresses, or will the entire <br />pipeline be installed and tested prior to commencement of burial? <br />Response 4: In general, Climax is planning to construct the Robinson Lake Pipeline from the new <br />RL Pump Station to the new Mill Tanks between 31 July and 7 November 2008 and 1 June and 18 <br />September 2009. The anticipated construction sequence for pipeline pressure testing is under <br />development and Climax anticipates that the pressure testing schedule will be provided to DMRS in <br />June 2008. Climax will work closely with DRMS regarding the pressure testing schedule so that <br />DRMS can observe the testing at its discretion. <br />Comment 5: With the construction of the proposed new mill, and in particular the new reagent <br />building, a detailed Emergency Response Plan for Designated Chemicals is required in accordance <br />with Rule 8.3. DRMS is willing to defer provision of the plan to a later time if you so chose. A <br />stipulation to provide this information and gain approval of the plan prior to taking initial delivery of <br />reagents would then be incorporated into the approval of TR-14. <br />Response 5: Climax will modify and present a revised version of its Emergency Response Plan (Part <br />8 of the Emergency Procedures and Responsibilities) for designated chemicals used and stored in the <br />Reagent Building: Climax requests DRMS to defer provision of the plan to later in 2008 as a <br />stipulation in the TR-14 approval letter. <br />Your expeditious review of these responses will be very much appreciated and we look forward to <br />your approval.
