Re: M-1988-044 Coal Creek Resources, Technical Revision TR-3 and Financial
Warranty Problem for Amendment 03
Dear Mr. Davis,
On May 23rd, 2008 the division received a technical revision for the above stated mine
site. The revision itself appears to the technically adequate. However several problems
about the financial warranty still exist regarding Amendment 03 that was approved on
April 7th, 2006.
Several letters have been sent to you over that last few years regarding this problem and
you have responded with several pieces of documentation. However, we need two
specific documents that you sent to the division on May 4th, 2007, entitled "Financial
Warranty Certification of Net Worth and Certification of Fixed Assets" and
"Performance Warranty". These documents have several technical errors that needed to
be corrected and then resubmitted. A letter was sent to you dated May 7th, 2007
(Certified Mail No. 7003 1680 0000 6429 6183) by the Division concerning this issue
and it outlined the specific corrections that need to be made to these documents.
Enclosed is the May 7th, 2008 letter and a copy of the original documents that needs to be
corrected. Please fill out and re-submit the "Financial Warranty Certification of Net
Worth and Certification of Fixed Assets" and "Performance Warranty" forms. Also,
enclosed is a blank copy of the form as well.
Once the correct forms have been filled out and received by the office and is deemed
correct the Technical Revision will be approved. Please be advised that the decision date
for this revision is June 22nd, 2008. If the Office has not received the requested
documentation, prior to the decision date or you have not requested an extension for the
decision date, the Technical Revision will be denied.
