Box 628 <br />Nuda, (olorodo 81424 <br />RE: Reclamation Phase 1 8~ 2 Bond Release Notification for Areas East of 2800 Rd. <br />Td~lane 974864.2165 <br />ka 910/864-2168 Dear Mr. & Mrs. Benson, <br />• <br />Western Fuels Colorado, is appiy~ng for a Phase 1 and 2 bond release for part of its n3daimed <br />New Horizon #2 Mine located 1 mile west of Nuda, Colorado. As required by Colorado law, <br />whenever any part ~ any coal mine bond is to be released, all interested parties must be notified. <br />This letter is to notify you that Western Fuels-Colorado is requesting partial release of the current <br />bond amount for successful phase 1 (baddilling and grading to near original topography) and <br />phase 2 (revegetation to post-mine land use) reclamation of the New Horizon #2 Mine east of <br />2800 Rd. The permit number is C-81-008, which was initially approved in 1981. Ail mine areas in <br />this application were backfiiled, graded, topsoiled and reseeded to the approved reclamation plan. <br />Phase 3 bond release that deals with vegetation production standards and the ten year minimum <br />time dock has yet to be applied for. The requested bond reduction amount is to be calculated by <br />the Division of Reclamation, Mining, & Safety. <br />The general description of the property to be released is as follows: <br />T48N R18W -SECTION 3t3 - E1/2 E1/2 SE1/4 <br />T48N R15W -SECTION 31 - SW1/4 <br />T48N R16W -SECTION 1 - E1/2 NE1/4 NE1/4 <br />T46N R15W -SECTION 6 - N1/2 <br />The parcel of land in question is located on the U.S.G.S. NUCI.A Quadrangle. <br />Written comments, objections and requests for publ~ hearing or informal conferences should be <br />submitted to: <br />Colorado Division of Reclamation, Mining, & Safety <br />215 Centennial BuBdIng <br />1313 Sherman Street <br />Denver, Colorado 80203-2283 <br />The full bond release application will be submitted to the Colorado Division of Reclamation, Mining, <br />& Safety in the thud week of May, 2008. A copy will also be placed on file at the Montrose County <br />extension office in Nuda. Ali information on the mine location. maps, revegetation, etc. is contained <br />in this application.
