This application has been prepared and is submitted in accordance with the Colorado Division <br />of Minerals and Geology (DMG) Guideline Regarding Selected Coal Mine Bond Release Issues (April 18, 1995), Rule 3.03 Release of <br />Performance Bonds. <br />Copies of the letters sent to surface owners within and adjacent to the permit boundary, holders of easements on the <br />property, and local government bodies providing written notice to seek release are included in the application package. <br />The "Public Notice" was sent to the Steamboat Pilot for four (4) continuous publications. The first publication <br />occurred on May 11, 2008. The Proof of Publication" will be provided to the Division of Reclamation, Mining and <br />Safety upon receipt from the newspaper. <br />A copy of this application has been sent to the DRMS (Denver office), OSM, CDOW and filed in the Hayden Public <br />Library for public review. <br />If there are any questions or comments, please contact me at the address below. <br />Sincerely, <br />Roy A.
