The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy ~.
review of Bowie Resources LLC's (BRL) submittal dated February 2, 2008 for Permit Revision ~~
No. 11 (PR-11) for the Bowie No. 2 Mine. The review of PR-11 focused on the revised mine
plan change as well as on the Federal Coal Lease COC-61209 modification. PR-11 can not be
approved, however, until the issue of mining within one mile of the Bruce Park Dam and the
Terror Creek Reservoir and the issue of down gradient ground water wells are resolved in PR-l0a'

The following are the Division's questions and comments.
Rule 2.03
1. The Division will conduct an Applicant Violator System (AVS) computer check of the
Bowie No. 2 Mine permit during this adequacy review period. The Division will conduct
similar AVS checks at the time of the Division's proposed decision and at issuance time
for PR-11. The Division will inform BRL of the results. ~
Rule 2.04
2. As had been acknowledged in the BRL PR-11 cover letter and as had been requested in
the attached Colorado Historical Society (OHS) comment letter dated February 20, 2008, I~
please provide a cultural resource survey for the federal lease modification area. The
Division will forward a copy to the CHS for their review. ~,
