1.7.2 Professional Engineer's Certification <br />• I, Michael D. Ellis, P.E., hereby attest that I am familiar with the CC&V Facility and I also understand <br />the Rules and Regulations promulgated under 40 CFR Part 112 Oil Pollution Prevention and how they <br />apply. Furthermore, I personally visited the Site on March 31 and April 1, 2003 for the purposes of <br />gathering information in order, to prepare this SPCC Plan. The SPCC Plan has been. prepared in <br />accordance with good engineering practice, including considerations given for applicable industry <br />standards as well as the requirements of 40 CFR Part 112. Procedures for inspecting and testing the <br />tanks and containers have been established and are herein incorporated. Based on my professional <br />engineering judgment, this SPCC Plan is adequate for the CC&V Facility. <br />This certification in noway relieves the owner or operator of the facility ofhis/her duty to prepare arid <br />fully implement this SPCC plan in accordance with the requirements of 40 CFR Part 112. This plan <br />is valid only to the extent that the facility owner or operator maintains, tests, and inspects equipment, <br />containment, and other devices as prescribed in this Plan. j <br />• <br />Michael D.
