from Task 112. Should Trapper Mining Inc. propose to have more drill holes than the <br />estimated 75, additional tasks will need to be added to the estimate to cover the cost of <br />reclamation. Task 114 and associated indirect costs will be added to the Permit Renewa105 <br />reclamation cost estimate. <br />Trapper Mining Inc. identified a duplicated cost in the Division's December 2007 reclamation <br />cost estimate. The Division confirmed that Task 107 and Task 130 were duplicates. Upon <br />closer investigation, the Division found that Task 107 was the correct Task to retain in the cost <br />estimate. Costs associated with Task 130 have been removed from the estimate. Additional <br />study of the December 2007 cost estimate found that the Division had also duplicated costs for <br />the reclamation of Sage Pond No.l and No.2, Tasks 167 and 168. The duplicate costs were <br />removed from the revised estimate. <br />The Division found that Tasks 102 and 202 were not reflected in the summary sheets. Task <br />102 is the cost of backfilling spoil cover over the northern portion of pit A-Ash dump (cross- <br />sections provided by TMI). Task 202 is the cost associated with grading cut and fill slopes on <br />the pit D/E haul road. Costs associated with these tasks have been added into the revised <br />estimate. <br />The adequacy item is resolved. <br />Division's initial comment No. 4: Please update Threatened and Endangered species and <br />discuss the potential impacts to current State and Federal Threatened and Endangered plant and <br />animal species lists (Permit Section 2.3.5). The Federal and State listed species of concern may <br />have changed over the years. To find the most up to date lists, the following websites may be <br />useful; USFWS-http://www.fws.gov/mountain%2Dprairie/endspp/CountyLists/Colorado.pdf <br />and DOW- <br />Trapper Mining Inc. 's initial response: TMI updated permit page 2-121 for plant threatened <br />and endangered species and permit pages 2-141 through 2-143 for animal species. <br />Division's response: Only one updated threatened and endangered plant species potentially <br />exists within the elevated range of the mine permit area: Wetherill Milkvetch (Astragalus <br />wetherill). However, the habitat description of this species does not exist on the mine site. <br />Therefore, no updated listed plant species of concern has a probability of being found on the <br />mine site. <br />TMI reports that there are no areas within or adjacent to the mine plan area that have been or <br />are pending designation as "essential habitat" for any of the threatened or endangered animal <br />species that could potentially occur in respective areas. <br />The adequacy item is resolved. <br />
