The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed Blue Mountain
Energy's Permit Revision, PR-6. Please respond to the following adequacy comments as necessary:
According to Section 34-33-110(2)(p) of the Colorado Surface Coal Mining Reclamation Act,
the permit shall include a statement of the result of the test borings or core sampling from the
permit area, including logs of the drill holes; the thickness of the coal seam; and an analysis of
the chemical and physical properties, including sulfur content, of such coal; a chemical analysis
of potentially acid-forming or toxic-forming sections of the overburden; and a chemical
analysis of the stratum lying immediately underneath the coal to be mined; except that the
provisions of this paragraph (p) may be waived by the board or office with respect to the
specific application by a written determination that such requirements are unnecessary.
Please provide a statement of the result of the test borings or core sampling for the proposed
permit area or either a statement discussing why such requirements are unnecessary.
2. Please provide a statement as to whether or not the proposed permit boundary includes land
within three hundred feet of any occupied dwelling, unless waived by the owner thereof, or
within three hundred feet of any public building or school, church, community, or institutional
building or any public park, or within one hundred feet of a cemetery per section 34-33-
114(2)(g)(V).
3. Per Rule 2.05.6(6)(a), please provide an inventory of all structures and renewable resource
lands which exist within the proposed permit area and adjacent area. The term structures
include any and all public roads.
