Cattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed Blue Mountain <br />Energy's Permit Revision, PR-6. Please respond to the following adequacy comments as necessary: <br />According to Section 34-33-110(2)(p) of the Colorado Surface Coal Mining Reclamation Act, <br />the permit shall include a statement of the result of the test borings or core sampling from the <br />permit area, including logs of the drill holes; the thickness of the coal seam; and an analysis of <br />the chemical and physical properties, including sulfur content, of such coal; a chemical analysis <br />of potentially acid-forming or toxic-forming sections of the overburden; and a chemical <br />analysis of the stratum lying immediately underneath the coal to be mined; except that the <br />provisions of this paragraph (p) may be waived by the board or office with respect to the <br />specific application by a written determination that such requirements are unnecessary. <br />Please provide a statement of the result of the test borings or core sampling for the proposed <br />permit area or either a statement discussing why such requirements are unnecessary. <br />2. Please provide a statement as to whether or not the proposed permit boundary includes land <br />within three hundred feet of any occupied dwelling, unless waived by the owner thereof, or <br />within three hundred feet of any public building or school, church, community, or institutional <br />building or any public park, or within one hundred feet of a cemetery per section 34-33- <br />114(2)(g)(V). <br />3. Per Rule 2.05.6(6)(a), please provide an inventory of all structures and renewable resource <br />lands which exist within the proposed permit area and adjacent area.
