The Public Comment Period began and comments were to be submitted to <br />DRMS in writing. This amendment application was officially filed January 4, 2008. <br />Publication of Public Notice: Starting January 12, 2008, Battle Mountain began weekly <br />publication of the public notice for four consecutive weeks in the Valley Courier. In addition, Battle <br />Mountain mailed a copy of the notice to all landowners adjacent to or within 200 feet of the site. <br />Public Comment Period: Typically, the public comment period ends 20 days after the final <br />published public notice. In this matter, the public comment period was voluntarily extended an extra <br />10 days, ending March 3, 2008. Objection letters received by DRMS were sent to Battle Mountain. <br />Notices of Pre-hearing Conference and Formal Board Hearing: DRMS issued notice of these <br />meetings to all parties by letter dated March 25, 2008. A 30-day notice is required prior to the <br />Formal Board Hearing, which is currently scheduled for June 11-12, 2008 in San Luis. <br />DRMS Recommendation for Approval or Denial: This recommendation to the Board is due 150 <br />days after the filing date unless Battle Mountain requests an extension of this recommendation date. <br />DRMS Recommendation Rationale Notice: DRMS must mail the recommendation and rationale <br />for approval or denial to all parties at least three working days prior to the Pre-hearing Conference. <br />Pre-hearing Conference: This conference clarifies the proposed issues to be heard at the Formal <br />Board Hearing and helps set the proposed hearing agenda. This conference is for those with "party <br />status" only, and they must provide witness lists and exhibits at this conference. The Pre-Hearing <br />Conference is currently scheduled for May 28, 2008 in San Luis. <br />Motions Filing Period: Motions must be made in writing and filed by participating parties no later <br />than two working days following the Pre-hearing Conference. <br />Pre-hearing Conference Order: The proposed Pre-hearing Conference order and hearing agenda <br />will be made public to all parties prior to Formal Board Hearing. <br />Motions Response: The Board must receive written responses to all motions at least three working <br />days prior to the Formal Board Hearing. <br />Formal Board Hearing: The Formal Board Hearing on this application must be held before the <br />180th day after the filing date (June 30, 2008) or the application is automatically approved. At this <br />hearing, Board members will hear testimony from DRMS and the parties. Non-parties will have the <br />opportunity to address the Board during Public Comment. The Board will then render its decision. <br />
