6.4.7 EXHIBIT G -Water Information <br />The small areal disturbance and shallow excavation created by this gravel pit will not directly <br />affect surface or ground water systems. The open, un-reclaimed pit area will not exceed 20 acres <br />at .any time during the mining operation. <br />The pit is not located within a natural drainage system. The pit is expected to encounter an <br />underground aquifer. This aquifer is the sandstone which underlies the gravel deposit and may <br />extend into the gravel bed itself. The Operator will not affect the aquifer. The mining plan <br />explains how the Operator will adjust the projected horizon of mining to leave a minimum of 2 <br />feet of undisturbed material above the ground water table. <br />A berm along the exposed gravel outcrop at the west end of the Phase I and II pits will contain <br />within the pit the runoff of precipitation events. The porous nature of the soils in this area and the <br />gentle slope of the pit development will allow the runoff created by brief periods of spring snow <br />melts and summer rains to infiltrate into the ground surface. No additional measures will be <br />required to control surface flow. <br />No sedimentation pond is designed or anticipated. Therefore, the Operator/Applicant has not <br />applied for a National Pollutant Discharge Elimination System permit from the Water Quality <br />Control Division of the Colorado Department of Health. <br />The washing of sand and gravel is anticipated as demand dictates. Water will be obtained from a <br />non jurisdictional Angie Pond that will collect waste irrigation return flow. The waste irrigation <br />water will be pumped from the small reservoir located in the field north of the Phase III mining <br />area to a small pond in the Phase I pit area. This pond will be located in the southeast corner of <br />the pit. Water will re-circulate through the pond so the majority of the consumptive use will be <br />the increase in moisture content in the product washed. <br />Williams Construction Co. has a storage water right for the Angie Pond through District Court, <br />Water Division 4, Case Number 03CW 131. The absolute water right is for the storage of 12.0 <br />acre-feet of water for industrial uses. <br />The small reservoir will be located on the bottom of the pit floor which consists of clay. This clay <br />pit floor will isolate the reservoir from any adjacent ground water sources. The clay was tested by <br />Lambert and Associates. The remolded permeability test results showed a permeability of 1.3 x <br />10-7 cm/sec which is virtually impervious. <br />Dr. Michael DeJohn, the owner of record of all lands included within the permit boundary, holds <br />"all water and water rights, ditches and ditch rights, minerals and mineral rights appurtenant <br />thereto or used in connection therewith including but not limited to 125 shares of The Farmers <br />Water Development Company." 2 <br />ZTaken from the QUIT CLAIM DEED dated January 7, 2000 between Esther Ellen <br />Kelley and Tom Friedas Kelly and Blackburn Ranches, a partnership as grantor(s), and Michael <br />DeJohn, included in Exhibit N -Source of Legal Right to Enter. <br />G-1 <br />
