The Agreement between Louisiana Land and Gravel Company, LLC and Farmer's provides fora 50 <br />foot wide buffer zone between its excavation operations and the centerline of the Gurley ditch after the <br />clay liner is installed. The agreement also allows Louisiana Land and Gravel Company, LLC to <br />stockpile material within 15 feet of the edge of the Gurley Ditch. <br />Excavation of the gravel pit will create a steep but stable advancing slopes. The slopes will be reduced <br />to a 2.Sh:ly before topsoil is applied and graded to depth. The advancing steep face will be reduced <br />to a 2.Sh:ly slope when the pit is 125 feet from the centerline of the Gurley ditch. The slope of the pit <br />excavation immediately west of the 50 foot wide Gurley ditch buffer zone will not be steeper than <br />2.SH:1V at any time during the mining operation. The effective slope between the edge of the Gurley <br />Ditch and the pit floor will be about 3.8h:1 V assuming the ditch is about 20-feet wide. Care will be <br />taken to keep all activities and disturbance within the projected pit disturbance boundaries. <br />A large portion of the projected disturbance are within areas where the vegetation can be characterized <br />as noxious weeds and cheat grass. Noxious weeds on the permit area will be controlled per the Weed <br />Control plan included in Exhibit J -Vegetation. <br />A small portion of the Phase III area is interspersed with wetland species. The applicant does not <br />believe this small area is a jurisdictional wetland due to the influence of irrigation water. The letter <br />from the Corps of Engineer, located in Exhibit J, confirms that the wetland is not jurisdictional. <br />Mining experience has shown that any perennial ground water encountered lies on a clay layer, which <br />apparently underlies the entire pit. Agravel/clay mix that cannot be processed by the Operator lies <br />approximately 24" above this solid clay layer. When this graveUclay mix is encountered, mining <br />ceases at that level. This serves as a self limiting factor that has remained constant since mining began, <br />and leaves at least 2' of undisturbed material above the perennial water table. Test holes are <br />periodically excavated to confirm the lateral continuity of the clay layer and the graveUclay layer.mix. <br />The access road, which directs all truck traffic to all three phases of the gravel pit, accesses the county <br />maintained Redvale Road approximately 550' east of the nearest dwelling. The planning of this road <br />minimizes the effects of dust and noise generated by the operation on the rural lifestyle of the local <br />community. <br />Operating hours of the pit are controlled the Montrose County Special Use Permit. <br />Overhead power lines as illustrated on the Exhibit C-1 Pre-Mining Map, cross the Phase I and Phase II <br />areas. San Miguel Power Association maintains an easement for these structures. The gravel operation <br />will not affect the stability of these structures. <br />The only commodities to be mined are construction materials. Construction materials include but <br />are not limited to pit run gravel, road base, and screened/sized gravel. No secondary commodities are <br />to be mined or extracted. <br />The construction products will be used for the production of asphalt, concrete and road construction. <br />The gravel products are also used as select and special fill for construction sites. <br />Sand and gravel will be washed as demand dictates. The main demand is for masonry sand. <br />D-3 <br />
