On behalf of Louisiana Land and Gravel, LLC, following <br />are its responses to the DRMS' comments and concerns. <br />1. Louisiana Land and Gravel rectified its delinquent status. Enclosed is a <br />certificate of good standing from the Secretary of State's Office. <br />2. Enclosed is proof of publication of the public notice circulated in the local <br />newspaper and sent to the appropriate owners of record of surface lands. <br />3. The clarification was made to the first line in the Mining Plan Narrative, page <br />D-1. <br />4. A statement was added to clarify the containment size for the fuel tanks. The <br />concept of the storage trailer is that oil, grease and antifreeze are stored in a <br />cabinet in the trailer that is suitable for containment. Therefore raised <br />thresholds are not required. Additionally, this issue was raised by Steve <br />Shuey in 2003 and it was concluded the language in the permit was <br />acceptable. See attached letter to Steve Shuey dated July 25, 2003. <br />5. The approved permit has the 2.5H:1 V pit slopes. This change was approved <br />by the DRMS through permit amendment no. 1. <br />6. The term refuse was changed to waste material from the pit. <br />
