Cattany <br />Paonia, CO 81428 Division Director <br />Natural Resource Trustee <br />Re: North Fork Pit, Permit No. M-2004-025, Technical Revision Approval, Revision No. TR-1 <br />Dear Ms. Farnsworth: <br />On May 2, 2008 the Division of Reclamation, Mining and Safety approved the Technical Revision application submitted to the <br />Division on April 18, 2008, addressing the following: <br />Revision to mine plan. Relocate topsoil stockpile location from East to South side ofpermit area. <br />No longer a phased mining operation; complete reclamation will occur after mining is completed. <br />Trench will no longer be constructed around perimeter of mine for de-watering purposes. Water encountered will <br />be pumped into ditch and transported into existing pond. <br />The terms of the Technical Revision No. 1 approved by the Division are hereby incorporated into Permit No. M-2004-025. All <br />other conditions and requirements of Permit No. M-2004-025 remain in full force and effect. <br />The current financial warranty of $22,212.00 is sufficient at this time. <br />If you have any questions, please contact me. <br />Sincerely, <br />Travis H.
