1. On the currently approved Map 23A there is a purple area that delineates the Section 16 mining area (the X-Pod area) that was approved with Technical Revision 65. This layer was removed from the new Map 23A, submitted with Technical Revision 69. Please add the layer that delineates the Section 16 mining area (the X-Pod area) that was approved with Technical Revision 65 to the new Map 23A submitted with Technical Revision 69. Response: The new Map 23A, approved under TR-65, was superseded by the old Map 23A, submitted and approved under PR-02. The X-Pod mining area is now included in the South Taylor Mine Plan (i.e. Map 23A). Thus the X-Pod mining block has been removed from Map 23A under the approved PR-02 package. 2. Both the currently approved Map 23A and the revised.Map 23A show highwall mining areas for the years 2008-2012. Colowyo is reminded that the Division does not currently have an approved plan for highwall mining in the South Taylor Pit. This is the subject of Stipulation 9, which states: Prior to conducting any highwall mining in the South Taylor Pit the Colowyo Coal Company shall submit a TECHNICAL revision to the Division including a mining plan and sequence, a stability analysis and a zero subsidence analysis and plan. Highwall mining may not begin in the South Taylor Pit until the aforementioned revision has been approved by the Division. Response: Should Colowyo commence highwall mining in the South Taylor Pit, Colowyo will submit a proper Technical Revision to the Division to revise the permit prior to commencement of mining.
