The revision proposes to incorporate the As-Built information <br />and certification for Sediment Ponds 011 and 013. The applicant is proposing modifications to the <br />design of flow control mechanisms in the sediment ponds (i.e., 011 and 013). These mechanisms <br />control the volume of water and sediment discharged to the stream system. <br />The applicant has provided supplemental information related to the sediment ponds 011 and 013. <br />Ponds 011 and 013 are formed by surface impoundments and do not intercept groundwater <br />according to the applicant. Ponds 011 and 013 have decreed conditional water rights in the amount <br />of 4.40 acre-feet and 6.06 acre-feet as identified in Case no. 01CW114. The decreed uses for both <br />ponds are irrigation, stockwatering and mining purposes, including but not limited to dust suppression <br />and sediment control. The applicant will be allowed to operate the two ponds in accordance with the <br />decree as long as groundwater is not intercepted. If groundwater is intercepted, an augmentation <br />plan will be required..
