Dear Mr. Benton:
Sorry for the lack of an approval letter for Acreage Release AR-O1. Although our database shows that the acreage
release was finalized one month after the decision date, I cannot find a record of the final approval letter. This letter
will act as the final approval letter for this permitting action.
On November 16, 2005, the Colorado Division of Reclamation, Mining and Safety approved the request for release of
a portion of the permit area from further reclamation responsibility. The new permit boundary and area are shown on
maps that the Division received and approved on November 2, 2005.
The permit area was reduced to approximately 862 acres, through the release of approximately 377 acres in this permit
action. Only approximately 15 acres of the released area were actually mined whereas the remaining 362 acres were
never mined or disturbed in any way by the mining operation. Because the permit is not totally released, you are still
liable for filing annual reports and fees.
