Canany <br />Denver, CO 80201-6667 Division Director <br />Natural Resource Trustee <br />Re: Terror Creek Loadout (Permit No. C-1983-059) <br />Permit Renewal Application No. 5 (RN-5) <br />Dear Mr. Johnston: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on January 20, 2008, an application to renew an existing permit to conduct <br />coal loading operations at the Terror Creek Loadout was considered complete for the purposes of filing. All review and <br />comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. <br />Unfortunately, I did not send to you or to the US Fish & Wildlife Service a completeness letter at the time of completeness. I <br />apologize for this inconvenience. <br />The permit area is located about 4 miles northeast of Paonia, Colorado and is further described as follows: <br />Portions of Section l5, Township 13 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. <br />In Permit Renewal No. 5, The Terror Creek Company is proposing to continue coal loading operations at the Terror Creek <br />Loadout for another five year term. The permit area is comprised of 20 acres, with 13.8 acres being disturbed. It does not appear <br />that the threatened & endangered species information in the Terror Creek Loadout permit application has been updated since its <br />initial permit application in 1983. However, due to the very small permit area, please inform the Division as to whether or not <br />the Terror Creek Company needs to update their permit with a new threatened & endandered species survey. <br />A copy of the renewal application is available for public inspection at the Delta County Planning Office, 501 Palmer Street, <br />Delta, CO 81416, and at the Division office.
